POPUSERVE HOSTING TERMS OF SERVICE
 

YOUR ACCOUNT HAS CONFLICTED WITH ONE OR MORE ITEMS STATED HERE ON THIS TERMS OF SERVICE PAGE

By purchasing hosting from us, you understood that you and your clients are legally bound to and agree to everything stated here.
Unfortunately you have breached these terms in some way.
The following terms are strictly non-negotiable
Our legal team reserve the right to update these terms of service at any time:
 


We are extremely proud of the speed and efficiency of our servers.
We look after your AND closely monitor our servers to ensure we can continue to provide the top level hosting service everyone deserves!
With this in mind, please ensure you fully understand and agree to the following before purchase.

The following are examples of websites/content/activities which are strictly NOT permitted on our servers
and are therefore subject to account suspension/termination at our discretion:
  • websites offering/storing/using/referring to ANY illegal/dubious/offensive material what so ever are strictly not permitted on our servers
    including but not exclusive to: illegal downloads/cracks/nulling/torrents/warez/rapidshare/rapidleech/software/scripts etc
  • websites offering/storing/using any kind of online game play are strictly not permitted - more often than not such websites will affect the overall server performance
  • websites offering/storing/using IRC/chat scripts are strictly not permitted
  • websites offering/storing/using proxy servers are strictly not permitted
  • websites which degrade the server performance are strictly not permitted
  • websites offering/storing/displaying x-rated/pornographic/offensive content/material/images are strictly not permitted
    HOWEVER, shops for adult sex toys and/or lingerie etc ARE permitted if they are tasteful and cannot be considered offensive/x-rated/pornographic
  • websites which contain non-essential files such as website backups/personal reference files/photos excessive email storage etc are strictly not permitted,
    therefore ALL server storage usage should ONLY pertain to that specific website and its functionality
  • to confirm the above point, you/your clients must download all backups directly to your pc and never leave them on the servers
  • you/your clients must ensure all email accounts do not store emails older than 30 days old
  • you/your clients must ensure you do NOT collect junk emails/automated/catchall emails or such as cron jobs/autoresponders etc on our servers at any time
  • you/your clients must not use any part of your storage for your own personal use at any time
  • you/your clients must therefore ONLY use our servers for hosting your 'live' websites
  • you/your clients may not store accounts on our servers when the name servers are not pointing to the server and therefore the site is not 'live'
  • you/your clients may not create accounts for domain names which have not been registered
  • you/your clients must NOT run any websites which may be deemed a security threat to our servers,
    including but not exclusive to: old php scripts, scripts where hackers can send spam/attack your website/our servers etc
  • you/your clients may not offer anonymous ftp access to ANY sites hosted on our servers
  • you/your clients may not use SSH to access any part of our servers


    Furthermore:

In the event that phishing / spamming activity is detected through any of your accounts, we will immediately suspended the account concerned in order
to prevent further emails being sent. In severe circumstances the account concerned may be terminated.

Accounts which are suspended (either by us or by you) and remain suspended for 7 days or more days will be deleted from our servers
to release more server space unless we agree/you are informed otherwise.

All resellers are solely responsible for advertising their own hosting services and are trading independently from Popuserve.

In general if you/your clients have a website which is not complying with one or more of the terms stated here,
the reseller of the account will usually receive a written warning notice.
In severe circumstances we reserve the right to terminate any offending account(s) without prior warning if deemed necessary for the security/performance/legality of the server concerned.

Please also be aware that you, our resellers, are not permitted to offer free hosting on our servers whatsoever.
Nor are you, our resellers, permitted to offer one-time hosting fee packages under any circumstances..
This is because we can choose which server we install a new account on and can offer one-time fees from time to time knowing that our servers will not be overloaded.
But you do not have this luxury and therefore you may not offer free or one-time hosting fee packages at any time because we do not
(and we're sure you don't either) wish to see our servers being overloaded/oversold under any circumstances.

We trust you and your clients will use common sense to establish if your site(s) fall into any of the above categories or could be deemed inappropriate for our servers.

Anything not explicitly stated in this TOS is subject to interpretation at our sole and absolute discretion.
You, as a Popuserve client, are solely responsible for ensuring that the content stored on and served by your Popuserve service meets our TOS at all times.

If your reseller account is known to be linked to another reseller which is/has been causing us problems, we reserve the right to restrict your reseller account as we see fit.
 


Payment Terms:

We only accept payment via Paypal. For online auctions, all payments are due within 48hrs from end of auction. No exceptions due to previous  timewasters. In the event that no payment is received within those 48hrs and we have not heard from you, we will have no choice but to raise an unpaid item dispute and an unpaid item strike will go against your account if you do not agree that we can recoup our final value fee for the listing. We do not tolerate time wasters.

If your hosting package requires regular payments (this does not apply to our one time payment/ life time hosting package), e.g. if your hosting payments are due monthly, annually etc, you will receive an invoice via Paypal approx one week before your last hosting period expires. All payments are made in advance and are non-refundable. If your payment for the next hosting period is has not been received and cleared before the invoice payment is due, the account associated with your hosting package and therefore any accounts under it will face suspension and will remain suspended for 7 days (unless all outstanding monies are received and cleared in full). If, after 7 days of overdue payment and account suspension, all outstanding monies have not been received and cleared, your account will be permanently terminated.

If at any time after purchase, a false claim/chargeback/unfair dispute is raised against us, we reserve the right to suspend all accounts within your hosting package until a resolution is reached. Action taken by us after the dispute depends entirely upon the circumstances and the outcome, and appropriate action will be taken at our discretion.
We do not tolerate fraudulent activity of any nature.

If any hosting account(s)  within (and including)  your reseller hosting account is/are deemed to be using up too much of one server,
and we have to upgrade the resources of that server as a result, please be aware that you may incur extra charges for this.

 

Exceptional circumstances:


If at any time after purchase, a false claim/chargeback/unfair dispute is raised against us or a client is abusive/threatening towards our staff members for any reason, we reserve the right to suspend all accounts within your hosting package until a resolution is reached. Action taken by us after the dispute depends entirely upon the outcome and will be taken at our discretion.
We do not and will not tolerate fraudulent/threatening/inappropriate activity/behaviour of any nature.
This includes but is not exclusive to:
Paypal chargebacks
Unwarranted reports to eBay
Unwarranted feedback through eBay
Legal threats/action
Abusive/threatening emails to our staff members
etc

 

Free Templates:

We hope you enjoy the free templates available with every purchase.
They are offered to you on the understanding that they do not come with any technical support from us, nor do we make any claims that the templates are complete/in full working order.
You will need to upload them to your chosen hosting account and edit them to suit your website, prices etc.
There are thousands of free templates available on the internet and these are simply offered to you as a gesture of good will.
You/your clients may not sell/resell them.
You/your clients may offer them for free, just as we are doing for you :-)
 

Technical Support:

We offer one to one email support. A personal account manager will be assigned to you from the moment you contact us.
Please realise that our priority is you, to offer you the best server support where ever possible. This does not however include help with installing/migrating/transferring/configuring website contents or anything else which is not directly a server issue. Fantastico scripts are provided and updated through the Cpanel software. If a script they provide causes you problems, we suggest you go to the authors website and manually upload the latest version of the script, whilst following their instructions.
We specialise in server support. We do not website design, website troubleshooting etc, so all clients are solely responsible for their own website content, including the use of the free templates as detailed above.
When you become one of our resellers, you are still trading as a separate entity from us and are primarily responsible for supporting your own clients.
Your account manager will help you with your clients as much as possible at first because we all have to start somewhere, but again, please remember that you are our paying clients and we're dedicated to helping you with potential server issues. You will have your own paying clients and you should therefore be dedicated to helping them in what ever ways you see fit.
If you are good at  website designing for example, then that could be an additional service you offer on top of your hosting fees :-)
In the rare event that you do encounter any problems directly server related, please be sure to provide as much detail as possible (including your reseller domain and any affected domains)
to your personal account manager, and please do try to remain polite at all times - they are there to help, not to be moaned at ;-)

 

And finally...
So that's the red tape over with! As with most hosting companies, all sales are final and we do not offer refunds whatsoever.
This policy is the industry standard due to the non-physical nature of the service.
By purchasing hosting from us, you are agreeing to all of the above, in addition to what ever is mentioned on the specific item listing you are purchasing.

and we will be happy to take a look so we can give you a fast answer.
